Please read the terms and conditions carefully. By making a payment or using Harmony Popovski's services, the Client acknowledges that they have read, understood, and fully accept these terms and conditions. These terms are binding and do not require a signature to be enforceable
Price quotation
Charges for services provided by Harmony Popovski will be outlined in a price quotation sent to the Client. Quotations are valid for 60 days from the date of issue. After this period, Harmony Popovski reserves the right to amend or refuse to honour the quotation. A quotation will only be issued once the scope of work has been agreed upon and any necessary photographs have been provided by the Client.
Deposit and payment
Upon agreement of the scope of work, Harmony Popovski will issue an invoice to the Client via email. Payment is due upon receipt of the invoice and can be made via bank transfer to the details provided. Any delays in payment may result in a delay in the commission process
To secure a commission, the Client must pay a non-refundable deposit of 50% of the total commission cost. Commission slots and artwork completion are allocated on a first-come, first-served basis from the time the deposit is received. Estimated completion dates and project timelines provided at the time of enquiry are subject to change until the deposit has been paid. The deposit must be paid within 14 days of receiving the quotation to secure the commission. If the deposit is not received within 14 days, the commission will be considered void, and the slot may be offered to another Client.
Once the deposit has been paid, a final estimated completion date will be provided. Any delays in the completion timeline will be communicated promptly.
Once the final artwork is completed, a watermarked version will be emailed to the Client for approval. The Client must provide written approval (via email) within 7 days of receiving the watermarked version. If the Client fails to approve or provide feedback within this timeframe, Harmony Popovski reserves the right to consider the artwork approved, and the remaining balance will be due. Upon full payment, the final, unwatermarked artwork will be emailed to the Client.
Termination
Should the Client choose to terminate the commission after an agreement has been made, Harmony Popovski reserves the right to retain any payments made, including the deposit. Any work completed up to the point of termination may also be subject to a partial payment, at Harmony Popovski’s discretion.
If at any point the Client becomes uncontactable via email for a period exceeding 30 days, and after three consecutive emails have been sent without response, the commission agreement will be considered terminated with no refund of payment. Harmony Popovski will make a final attempt to contact the Client by email before considering the agreement terminated
Artwork process
Once work begins, Harmony Popovski will send updates to the Client after the initial sketch and again upon completion of the artwork. Minor alterations may be made at each stage as needed. The Client is entitled to 1 round of revisions per stage (sketch, final artwork). Additional revisions or significant changes beyond the agreed scope may incur additional charges. Once the Client approves the final artwork, it will be sent in one of the following formats: JPEG, PNG, or PDF.
Harmony Popovski reserves the right to share ‘work in progress’ photos to social media unless the Client expresses their wishes to keep the project confidential.
Copyright and Reproduction Rights
Harmony Popovski retains full copyright ownership of the artwork. The Client is granted a limited license for personal use. If the Client wishes to purchase full copyright or commercial rights to the artwork, a separate agreement must be signed and additional fees may apply.
Harmony Popovski reserves the right to display the artwork on their website and social media pages. If the Client does not wish for the artwork to be displayed, they must declare this upon placing the commission.
Any photographs of the artwork shared online or on social media by the Client must include a caption, tag, or annotation clearly crediting Harmony Popovski as the creator of the artwork. The Client is prohibited from making any digital or physical reproductions of the artwork without explicit permission from Harmony Popovski. Furthermore, any commercial use of the artwork by the Client, including but not limited to resale, licensing, or promotional purposes, is strictly prohibited unless a separate agreement is in place
